Agreement to Terms

These Terms of Service govern your use of the Bellweather Studios website, storefront, accounts, downloads, and related online services ("Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Accounts and Access

Some features require a Bellweather account. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.

• Provide accurate account and purchase information
• Maintain control of your account and authentication methods
• Not use the Services to interfere with the site, checkout flow, or license systems
• Not attempt unauthorized access to Bellweather systems or other user accounts

Payments and Refunds

All payments are processed through Stripe, our payment processor. Prices are listed in USD. All sales of digital products are final upon delivery.

If you experience technical issues that prevent you from using the Software within 14 days of purchase, contact keith@bellweatherstudios.com and we will review the issue. Refunds are not guaranteed, but may be issued at our discretion for verified technical problems.

Service Availability and Support

We may update, improve, suspend, or discontinue parts of the Services from time to time. We do not guarantee uninterrupted availability of the website, account portal, checkout flow, or related infrastructure.

Software License

Installation and use of Bellweather software is governed by our End User License Agreement. If there is any conflict between these Terms and the EULA on software-license matters, the EULA controls.

Acceptable Use

• Do not misuse the checkout, download, account, or license systems
• Do not attempt fraud, scraping, abuse, or service disruption
• Do not use the Services in a way that violates applicable law

We may suspend or terminate access to the Services if we reasonably believe misuse, fraud, abuse, or a material violation of these Terms has occurred.

Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Bellweather Studios disclaims warranties relating to the website, store, accounts, and online services.

Limitation of Liability

To the fullest extent permitted by law, Bellweather Studios shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Any liability relating specifically to the licensed software remains subject to the EULA.

Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

Intellectual Property

The Bellweather Studios website, branding, content, graphics, and related service materials are owned by Bellweather Studios and protected by applicable intellectual property laws. The software itself is further governed by the EULA.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tennessee.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of the Software after changes are posted constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the Services if you materially violate these Terms, commit fraud, or misuse Bellweather systems. Software-license termination is governed separately by the EULA.
